HIPAA Notice of Privacy Practices

Your Information. Your Rights. Our Responsibilities. This notice describes how medical information about your loved one (Participant) may be used and disclosed and how you can get access to this information. Please review it carefully.

Introduction:
John13 Community is committed to protecting the privacy of participant health information. This Notice of Privacy Practices (“Notice”) describes how we may use and disclose the participant’s protected health information (Participant’s PHI) to carry out treatment, payment, or health care operations and for other purposes that are permitted or required by law. It also details your rights to access and control the Participant’s PHI in connection with the online enrollment form for our day or summer program.

How We Collect Information About Our Participants:
John13 Community and its employees and volunteers collect data through a variety of means including information request documents, assessments, letters, phone calls, emails, voicemails, and from the submissions that are either required by law or necessary to process applications or other requests for assistance through our organization.

How We May Use and Disclose Health Information:
Information is only used as is reasonably necessary to process participant applications or to provide participants with services which may require communication between John 13 Community and other providers necessary to verify medical information is accurate and determine the level of support needed to provide services.

If individuals apply or attempt to apply to receive services through us and provide information with the intent or purpose of fraud or that results in either an actual crime of fraud for any reason including willful or un-willful acts of negligence whether intended or not, or in any way demonstrates or indicates attempted fraud, their non-medical information can be given to legal authorities including police, investigators, courts, and/or attorneys or other legal professionals, as well as any other information as permitted by law.

  • For Treatment: We will use and disclose the Participant’s PHI to provide, coordinate, or manage participant’s care and any related services.
  • For Operations: We may use or disclose, as needed, the Participant’s PHI to support the business activities of our program, including quality assessment activities, employee review activities, licensing, and conducting or arranging for other business activities.

Your Rights: You have the following rights regarding the PHI we maintain about the Participant.

  • Right to Inspect and Copy: You have the right to inspect and copy PHI that may be used to make decisions about the Participant’s care or payment.
  • Right to Amend: You may request to amend the information if you believe it is incorrect or incomplete.
  • Right to an Accounting of Disclosures: You can request an accounting of certain disclosures we have made of the Participant’s PHI.
  • Right to Request Restrictions: You can request a restriction on the PHI we use or disclose for treatment, payment, or healthcare operations.
  • Right to Request Confidential Communications: You can request that we communicate with you in a certain way or at a certain location.
  • Right to a Paper Copy of This Notice: You can obtain a paper copy of this notice at any time.
  • Right to be notified of a breach: You will be notified in the event of a breach of the Participant’s PHI or any other private information.

Changes to this Notice: We reserve the right to change this notice and make the new notice apply to PHI we already have as well as any information received in the future. We will post a copy of the current notice in our office and on our website.

Complaints: If you believe the Participant’s privacy rights have been violated, you may file a complaint with us or with the Secretary of the Department of Health and Human Services. To file a complaint with us, contact our Privacy Officer at the information listed above. You will not be penalized for filing a complaint.

Safeguards: We are committed to protecting the privacy and security of Participant’s personal and health information. We use a range of administrative, physical, and technical safeguards designed to protect the Participant’s information from unauthorized access, use, or disclosure. Our security measures include, but are not limited to, encryption of data during transmission and storage, controlled access to our facilities, secure disposal of electronic and paper records, and comprehensive training of our staff in privacy and security protocols. We continually evaluate and update our security practices to safeguard the Participant’s private information against emerging threats.
